The distinction that decides it

## Registry removal is not a refusal

Many people believe that taking their name off the state donor registry is enough. It is not, and the acts say so in terms.

- **Taking your name off (revocation):**This resets your status to blank. It bars no one. A hospital, a family member or a surrogate can still authorize the gift, because nothing on record says you refused.
- **A signed refusal:**This is the instrument the statutes provide for. It bars every other person from making an anatomical gift on your behalf, and it keeps working when you cannot speak. It only works if it is found in time, which is the part we do.

Taking your name off the donor registry is a *revocation*. A revocation bars no one. Only a signed *refusal* does, and only if it is found in time.

Background

## Why the wording is so similar, and why that is not the same as uniform

The Uniform Law Commission drafts model acts. A model act is not law and binds no one. Each legislature enacts its own statute, amends it as it likes, and that statute is the law for a person in that state. So there are fifty-one anatomical gift laws here, not one with exceptions.

What is true is that most of them were drafted from the same model, which is why their refusal provisions read alike. Where they do not, we say so rather than averaging it out.

The card in the code

## Where a card carried on the person is named in the statute

A card carried on the person is not something these statutes are silent about. Some of them name one in terms.

Five of the fifty-one: Delaware, Florida, Indiana, New York and Pennsylvania.

Execution

## Where your state asks for more than a signature

Most ask only for a record you signed; the ones that ask for more ask about witnesses, not about the refusal itself.

- **46 of the 51: your signature is enough.**Witnesses come into it only where somebody else signs at your direction because you physically cannot.
- **Louisiana asks for witnesses on every signed refusal,**including one you sign yourself: two adults, at least one of them disinterested. Your blank prints the witness page for you when Louisiana is your state.
- **Texas offers a notary acknowledgment instead of witnesses,**as an alternative rather than an addition, and in the one place witnesses are asked for at all: a record signed at your direction. No other state offers it.
- **Ohio asks for two adults and does not require either to be disinterested,**where witnesses are needed at all.

Two witnesses cannot weaken your document anywhere, so we suggest two wherever you are. A notary is not required by any of the fifty-one, and a notarized document is never worse than one without.
